At one from the many holy wars with Byzantium (East Roman Empire) Caliph Ali bi Abu Thalib radhiallahu anhu (may Allah be pleased with him) had as his share of the booty piece of soldier’s body armour. Unfortunately he lost the armour when he was riding his horse; it was fallen from the back of his horse.
Sometimes after that when was visiting the market he got a sight of his lost armour in the hand of certain jewish man. Caliph Ali radhiallahu anhu observed the armour carefully to avoid mistaken it for someone alse’s property. Only after he was convinced then he came to the Jew.
He asked the Jew where he got the armour from and told the man that the armour was his property. It had fallen from the back of his horse, if by any chance the Jew might have found the armour and picked it up. The Jew denied it. He said he had bough the armour the Jew could not show him.
Finally Caliph Ali radhiallahu anhu had to appeal the court to sattle the dispute. He claimed to Cadi or judge the Jew had taken his fallen armour. The judge asked Caliph Ali radhiallahu anhu: “Do you have any witness O’ Amirul Mu’minin (The Leader of the Faithful) to testify here that this your allegation?”
“Only my son,” answer him.
The judge continued: ”Forgive me O’ Amirul Mu’minin, your family cannot be the witness for you in this case according to the Shari at (the code of Islamic law).”
“If you cannot bring any other witness, I have to release this man then. He is not guilty.”
So the judge acquitted the Jew and gave his decision thet the armour rightly belonged to the Jew. Caliph Ali rodhiallahu anhu accepted this verdict calmly without any heart feeling though he knew the Jewish man was liar. He could not protest it because he could not bring a legal witness. It was a fair trial.
